Friday Trailer Co. Terms & Conditions

This sales agreement v2.2 (the “Agreement”) for products (the “Goods”) sold as per the supplied invoice (the “Invoice”) by Friday Trailer Company Pty Ltd. (the “Seller”) to the persons (“Buyer”) submitting this Agreement. The Agreement is effective as per the completed submission date and payment per the payment terms of the Invoice.

 

The Seller agrees to sell, and Buyer agrees to buy, the goods outlined on the Invoice in accordance with the terms and conditions of this Agreement:

 

Terms and Conditions

 

1. Delivery 

1.1. Estimated delivery and production milestone dates are defined on the Invoice. 

1.2. The Seller makes every effort to adhere to the scheduled dates, however should matters outside their control effect these dates they will notify the Buyer of the rescheduled dates in writing. 

1.3. The Seller is not liable for any losses arrising for delayed or postponed delivery of Goods to the Buyer.

 

2. Deposits and Payment Schedule. 

2.1. The Seller requires a non-refundable deposit of 30% of the total sale price to begin production. Deposit shall be paid within seven days of the Agreement being signed. A second 40% deposit is required at ‘walls up.’ Both to be made within one week of notification by the Seller. 

2.2. Final balance of payment is due one week prior to the collection date.

2.3. Deposits are non-refundable. 

2.4. Should the milestone or delivery date deviate outside the estimated range, the Seller will give the Buyer a minimum of two weeks’ notice for adjusted payment dates.

2.5. The Seller reserves the right to cancel the Agreement if they are unable to deliver the Goods. In the case of the Seller cancelling the Agreement a full refund will be issued.

 

3. Default

3.1. The occurrence of any of the following shall constitute a material default under this Agreement;

3.1.1. The failure to make a required payment when due.

3.1.2. The insolvency or bankruptcy of the Buyer.

3.2. The Buyer has seven days to remedy the Default, should this not be fulfilled the Seller has the option to terminate the Agreement and no refund is due to the Buyer. 

3.3. Should there be circumstances outside the Buyers’ control that cause a default, such as misfortune or acts of god, the Seller may, at their discretion, give a partial refund. 

 

4. Deviations & Changes to Order

4.1. Once production is confirmed per the Invoice specifications deviations or changes are not accepted. 

4.2. Due to supply chain complexities, in the event a product cannot be sourced to fulfil the completion of the order a substitute may be offered. In the event a substitute cannot be sourced the order will be delayed.

 

5. Manufacturer’s warranty

5.1. The Seller warrants the Goods sold are free from defects in materials or workmanship. The Goods made by the Seller are covered by a limited warranty of twelve months. 

5.2. Accessory and component parts, such as but not limited to, electrical appliances, shall fall under the original manufacturer’s warranty terms.

 

6. Fit for purpose

6.1. At the time of this Agreement being submitted, the Buyer has not disclosed, verbally or written, any intended purpose the Goods are not fit for. 

6.2. The Seller has verbally and in writing, clearly described fit for purpose. 

6.3. Off-road as it applies to these Goods, is a towable recreational vehicle suited to mild or light duty cross-country travel on dirt roads or trails without benefit of a sealed bitumen, concrete or paved roads.

 

7. Materials

7.1. Wood is a natural material and has variations in appearance and make up. The wood grain and colour may, and most likely will, vary from our published photos and the product you have viewed. Wood will also change in colour and tone over time, this is a natural property and not a defect.

 

8. Inspection & Handover

8.1. The Buyer is given the opportunity to inspect the trailer on collection day to ensure it meets the product specifications and is free from defects. The Seller will provide additional material about the product in the form of manuals and instructions. 

8.2. The Buyer is responsible for ensuring they are aware of towing requirements for the trailer and their tow vehicle. 

8.3. The Buyer accepts responsibility for ongoing maintenance of the trailer. 

 

9. Registration & Insurance

9.1. The Seller does not provide registration as part of the Invoice. The Seller will assist the Buyer register the trailer for the purpose of road use prior to delivery. Costs associated with registration can be paid by the Buyer directly, or the Seller can arrange and be reimbursed by the Buyer. 

9.2. The Seller will need to ensure appropriate insurance is in place prior to collection.

 

10. Entire Agreement

10.1. This Agreement contains the entire Agreement of the parties regarding the subject matter of this Agreement, and there are no other promises or conditions in any other Agreement whether oral or written. 

10.2. This Agreement supersedes any prior written or oral Agreements between the parties. Any amendments to this Agreement must be in writing and agreed to by both parties.
